Terms of Service

Sparkback helps businesses ask their customers for feedback and reviews by email and text, collects ratings and private feedback, and reports results. Sparkback never posts, edits or removes reviews on any review site, and does not guarantee any number of reviews or any rating.

You must give accurate information, keep your login secure and are responsible for activity on your account, including by people you invite. Tell us promptly about any unauthorized use.

Paid plans are billed in advance, monthly or yearly, through Stripe, and renew automatically until cancelled. New businesses get a 14-day free trial unless they choose to start a paid plan or a done-for-you setup. Done-for-you setup is a one-time fee charged with the first month. You can cancel any time from Billing; service continues to the end of the paid period. Fees are non-refundable except where the law requires otherwise. We may change prices with 30 days' notice.

You may add only customers who gave you their contact details in connection with your services. Before Sparkback emails or texts anyone, you must have their consent as required by law, including the TCPA and CAN-SPAM, and you must record it truthfully in Sparkback. Texts are sent under our SMS Terms, which you agree to follow. You may not import purchased or scraped lists.

You may not use Sparkback to send spam or marketing messages, to offer rewards for reviews, to ask only happy customers to post public reviews in a way that breaks a review site's rules, to post fake reviews, or for anything unlawful, deceptive or harassing. We may suspend sending or the account if we believe these terms are being broken.

You own the customer information and feedback you put into Sparkback. You give us permission to use it to provide the service, as described in our Privacy Policy. You can export it while your account is active.

Sparkback is provided “as is” without warranties of any kind. Message delivery depends on email providers and carriers outside our control. To the extent the law allows, we are not liable for indirect or consequential damages, and our total liability is limited to the fees you paid us in the 12 months before the claim.

You can stop using Sparkback at any time. We may suspend or end access for breach of these terms or non-payment. Sections that by their nature should survive termination will survive.

These terms are governed by the laws of the State of Illinois, USA, and disputes go to its courts.

We may update these terms. We will change the date above and, for significant changes, notify you by email or in the app. Continuing to use Sparkback means you accept the updated terms.
